LEGO® Bricktober Competition
Terms & Conditions of Entry
1. Information on how to enter and prizes form part of these conditions of entry. Entry into the competition is deemed acceptance of these conditions of entry. Entry is via the web.
2. Entry is open to all residents of Australia. Employees, Directors and their immediate families of LEGO Australia Pty. Limited, Wesfarmers Limited, RDI Marketing Pty Ltd, printers, suppliers, providers and associated agencies with this promotion are ineligible. New Zealand residents are ineligible to enter.
3. The LEGO® Bricktober Competition is a three tiered campaign and will involve:
(a) Registration
(b) Instant Win Consumer Promotion
(c) Game of Skill Competition
4. The Competition Period commences on Thursday 24 September 2009 at 00:01 (AEST) and concludes on Thursday 29 October 2009 at 23:59 (AEST).
REGISTRATION
5. To register into the competition, participants must head to www.kmart.com.au or www.bricktober.com.au and key in their personal details. Valid registrations must contain the following information:
(a) First and last name
(b) Mailing address
(c) Home phone number
(d) Mobile phone number
(e) Email address
(f) Male/Female
(g) Existing LEGO® CLUB member – Yes/No
(h) Date of birth – If the participant is 14 years or younger, the next section must be completed
(h1) Parent/guardians full name
(i) Create a USERNAME and PASSWORD
6. Participants will also have the option to select a LEGO® Minifigure as their online character. This is not a mandatory requirement. If a LEGO® Minifigure is not selected, one will be randomly selected.
7. Participants will also have the option to engage in the activities available online.
8. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
9. Incomprehensible and illegible entries will be deemed invalid.
10. All entries must be in English.
TIER 1: INSTANT WIN CONSUMER PROMOTION
11. To enter tier one (1) of the competition, participants must purchase any LEGO® product/s valued at $20 or over in one (1) transaction from Kmart and head to www.kmart.com.au or www.bricktober.com.au.
(a) Entrants log online with their registered USERNAME and PASSWORD.
(b) Entrants enter their Kmart transaction receipt number online as proof of purchase of the LEGO® product/s purchased, valued at $20 or more, in one (1) transaction.
(c) A Unique Bricktober Code will then be made available for the participants to download & print out. Participants must follow the instructions related to correct printer settings. The Unique Bricktober Code will be in PDF format.
(d) Participants must then bring in the Unique Bricktober Code printout to any Kmart store and head to the LEGO® section of the toy area.
(e) Participants must then place the Unique Bricktober Code underneath the Bricktober decoder to see if they have won a bonus prize.
(f) If the participant has won, they must head to www.kmart.com.au or www.bricktober.com.au, log online with their registered USERNAME and PASSWORD and submit the eight (8) digit Prize Claim Number located on the top right hand side of the Unique Bricktober Code. A request is made to ensure that the mailing address details are correct. The participant will then receive an email advising that their bonus prize application has been received.
(g) Upon confirmation of code, the participant will receive another email advising that their application has been accepted and that their weekly prize will be mailed out to the mailing address detailed in their registration.
12. Unrecognised codes will not be accepted.
13. The Promoter holds no responsibility for late or misdirected entries or incorrect mailing details keyed in the registration process by the participant.
14. Tier 1 prizes: There are 200 bonus prizes to be won over a five (5) week period. The 200 prizes are broken up into 4 groups. Each group will consist of 50 prizes to be won during its respective period.
15. Each group will have a separate theme and a different bonus prize. The bonus prizes are as follows:
(a) Group 1 – Fifty (50) LEGO® Space Police K9 Bot
(b) Group 2 – Fifty (50) LEGO® Red Brick Key Chain
(c) Group 3 – Fifty (50) LEGO® Indiana Jones™ Key Chain
(d) Group 4 – Fifty (50) LEGO® Star Wars™ Limited Edition Metallic Darth Vader™ Minifigure
16. The date range for each group mentioned in points 15.a, 15.b, 15.c and 15.d are as follows:
(a) Group 1 – Thursday 24 September 2009 at 00:01 (AEST) and concludes on Wednesday 7 October 2009 at 23:59 (AEST)
(b) Group 2 – Thursday 8 October 2009 at 00:01 (AEST) and concludes on Wednesday 14 October 2009 at 23:59 (AEST)
(c) Group 3 – Thursday 15 October 2009 at 00:01 (AEST) and concludes on Wednesday 21 October 2009 at 23:59 (AEST)
(d) Group 4 – Thursday 22 October 2009 at 00:01 (AEST) and concludes on Thursday 29 October 2009 at 23:59 (AEST)
17. Bonus prizes will be detailed on www.bricktober.com.au for its respective theme.
18. Two hundred (200) Instant win prizes will be available to random valid entrants during the Promotional Period (50 to be won, for each group of the promotion). The Unique Bricktober Code will need to be kept by the participant for prize verification purposes.
19. In the event of any dispute with the Promoter regarding prize claim entitlement, or at the Promoter's request, Instant winners will be required to correctly quote their eight (8) digit Prize Claim Number, located on the top right hand side of the Unique Bricktober Code, as well as their valid Kmart transaction receipt number, as proof of purchase of the LEGO® product/s purchased, valued at $20 or more, in one (1) transaction. This must be the same Kmart transaction receipt number that was keyed in at the time of entry to be awarded the prize. The Promoter reserves the right to withhold the awarding of an instant prize to a participant who cannot provide a valid eight (8) digit Prize Claim Number and a valid Kmart transaction receipt number.
20. Each individual valid Kmart transaction receipt number will entitle the entrant to one entry. Multiple LEGO® product purchases presented on a single valid transaction receipt will be deemed as a single entry only. Only one valid transaction receipt and Unique Bricktober Code entry will be accepted (i.e. each entry must be accompanied by a separate valid transaction receipt number and Unique Bricktober Code).
21. Each entrant will be required to retain their proof of LEGO® purchase in the form of their original valid Kmart transaction receipt and their winning Unique Bricktober Code. The Promoter reserves the right to request winners to provide proof of age, identity, proof of residency at the nominated prize delivery address, and/or proof of eligibility to enter. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
22. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. The Promoter will take no responsibility for lost, late or misdirected entries.
23. Instant win Unique Bricktober Codes are void if stolen, forged, mutilated or tampered with in any way.
24. The total value of all Tier 1 prizes is AUD $1,448.00 (including GST).
TIER 2: GAME OF SKILL COMPETITION
25. Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with these terms and conditions will be deemed invalid and will not be included in the judging. Participation in this competition is deemed acceptance of these terms and conditions of entry.
26. This competition is a Game of Skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon literacy and creative merit. All entries must be the original independent creation of the entrant and free of any claims that infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.
27. To enter tier two (2) of the competition, participants must purchase two (2) separate transactions of any LEGO® product/s, valued at $20 or over, in one (1) transaction from Kmart and head to www.kmart.com.au or www.bricktober.com.au
(a) Entrants log online with their registered USERNAME and PASSWORD
(b) Entrants submit their LEGO® transaction receipt number online two (2) times.
28. To enter into the major prize, each participate will be required to unlock two (2) Bricktober bricks. Everytime a participant logs in and keys in a valid entry to the competition, as well as receiving a Unique Bricktober Code, they also unlock a Bricktober brick. To unlock two (2) Bricktober bricks, participants must key in a valid entry to the competition two (2) times
29. Once this is done, the participant will have the opportunity to enter the major prize window online.
30. To enter into the major prize, each participate will be required to (in 25 words or less) create a caption to the photo supplied.
31. The Promoter holds no responsibility for late or misdirected entries. Entrants will be required to hold on to their original product receipt (for each entry they have made) as proof of purchase, in the event they are judged a winner.
32. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
33. Incomprehensible and illegible entries will be deemed invalid.
34. Entrants may only enter once for the major prize.
35. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity in the form of a store receipt, in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
36. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, street addresses or PO Box addresses to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
37. The judging will take place at LEGO Australia Pty. Limited, 2 Lincoln Street, Lane Cove NSW 2066 on Friday 13 November 2009, commencing at 12:00pm.
38. The best entry received, as determined by the judges, will win a trip for four (4), consisting of two (2) adults and two (2) children to LEGOLAND® California Resort. Children are considered between the ages of two (2) to eleven (11).
39. Major prize consists of:
(a) Return flights from Sydney (inclusive of domestic flights if necessary from the winners nearest domestic airport in Australia) to Los Angeles for four (4), consisting of two (2) adults and two (2) children including transfers from Los Angeles International Airport to the Grand Palisades Resort & Hotel, Carlsbad.
(b) Five (5) nights accommodation at the Grand Palisades Resort & Hotel for four (4), consisting of two (2) adults and two (2) children.
(c) A four (4)-day pass to LEGOLAND® California Resort for four (4), consisting of two (2) adults and two (2) children.
(d) Spending money of $2,000 AUD.
40. Major prize valued at RRP $11,250 (including GST).
41. Total maximum prize pool is valued at RRP $12,698 (including GST).
42. Prizes cannot be transferred or redeemed.
43. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
44. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
45. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
46. Prize values are based upon the recommended retail prices and market rates at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
47. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
48. All bonus prize winners will be notified via email advising them of their prize.
49. The major prize winner will be notified via phone and in writing advising them of their prize. The winner of a prize valued over $100 will have their name published in The Australian newspaper on Friday 20 November 2009.
50. Should an entrant’s contact details change during the competition period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
51. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
52. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
53. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
54. LEGO Australia Pty. Limited, RDI Marketing Pty Ltd, printers, suppliers, providers and associated and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
55. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this competition but no further use of this information will be made without prior consent.
56. The Promoter is LEGO Australia Pty. Limited, ABN 42001540914 of 2 Lincoln Street, Lane Cove NSW 2066.
